Article 1    The Teacher Evaluation Committee (hereinafter referred to as the “Committee”) is established in accordance with the University’s organization regulations.

Article 2  The Committee is formed by the following members:

I.        Ex-officio members: The vice president designated by the president, dean of academic affairs, dean of research and development, dean of Tsing Hua College, and deans of each college.

II.       Elected members: Each college shall elect one male and one female representative with professor qualifications, the president shall select one representative with professor qualifications from Tsing Hua College, and researchers shall elect one representative with professor qualifications.

Either gender shall account for at least one third of all Committee members.

For representatives of Tsing Hua College and researchers, each type of personnel shall first elect one male and one female representative from amongst themselves, and then the president will select the representative based on the gender of ex-officio members and members elected by colleges.

When each college, Tsing Hua College, and researchers are electing members, they shall elect the same number of alternate members of the same gender. When a member cannot attend a meeting for any reason, substitutes with the same faculty member rank shall attend on behalf of ex-officio members. Except where an elected member seat is replaced by an alternate member due to the seat being vacant, if an elected member cannot attend a single meeting for any reason, the member may not ask the alternate member to attend and vote on his/her behalf.

Where a member of a certain gender cannot be elected due to insufficient faculty members of that gender with professor qualifications in some colleges, if the number of members of a certain gender from colleges, Tsing Hua College, and researchers along with ex-officio members already reaches one third of all members, then the college may elect a member of the other gender.

If members of a certain gender in the list of members elected by each college, Tsing Hua College, and researchers along with ex-officio members is less then one third of all members, the president shall select alternate members to replace them.

The vice president serves as the chairman of the Committee.

Faculty members may not serve as committee members during temporary transfer, sabbatical leave, engaging in continuing education or research full-time, or unpaid leave. However, this does not apply to faculty members concurrently serving as an administrative supervisor during sabbatical leave.

Article 3    The term of elected members is two years, half of members are elected each year, and members may be elected to consecutive terms.

Article 4    The Committee convenes meetings at least once a semester and may convene extraordinary meetings whenever deemed necessary.

Article 5    The Committee reviews the following matters:

I.        The appointment and period of appointment of faculty members, researchers, and professional technicians.

II.       The promotion of faculty members, researchers, and professional technicians.

III.     Determination of the reason for suspension, dismissal, non-renewal, and severance of faculty members, researchers, and professional technicians.

IV.     Appeals of faculty members, researchers, and professional technicians who are dissatisfied with decisions of a college-level Teacher Evaluation Committee regarding their rights and interests.

V.      Other important matters related to the rights and obligations of faculty members, researchers, and professional technicians.

If the college-level Teacher Evaluation Committee decides to not suspend an appointment in Subparagraph III of the preceding paragraph in accordance with Article 22, Paragraph 1 of the Teacher’s Act, the suspension will not need to be submitted to the Committee for review.

If the appointment of an adjunct faculty member is terminated according to Article 11, Paragraph 1 of the Regulations Governing the Recruitment of Adjunct Teachers for Institutions of Higher Education, it shall be handled according to the preceding paragraph.

Article 5-1 For the appeal in Subparagraph IV of Paragraph 1 of the preceding article, the faculty member shall file a written appeal with the convener of the University Teacher Evaluation Committee within 15 days from the following day after the written notification of the decision is delivered, and review results shall be provided to the faculty member in writing.

Article 6    At least two thirds (inclusive) of all members must be in attendance during Committee meetings. Related personnel may be invited to attend such meetings to give reports or explanations, if necessary.

Article 7    When Committee members are reviewing cases, they shall recuse themselves if they have any one of the following conditions:

(I)      Where the Committee member or his/her spouse, blood relative within the fourth degree of kinship, or current or previous relative by marriage within the third degree of kinship is involved.

(II)     The Committee member previously had a teacher-student relationship with the involved party in regard to a doctoral dissertation or master’s thesis (degree dissertation advisor).

(III)   The Committee decides that the Committee member should recuse himself/herself due to other conflicts of interest with the faculty.

Article 8    If the review of an important matter of a faculty member and the decision made at the college-level clearly does not comply with the law or is clearly inappropriate with clear evidence, the University Teacher Evaluation Committee may directly conduct a review and make changes in accordance with regulations.

If the college-level Teacher Evaluation Committee does not handle a matter that was accepted by the teacher grievance agency or unit or requested by other remedy agencies or units according to the law, and the situation is deemed a violation of the law by the same teacher grievance agency or unit or remedy agency or unit, the University Teacher Evaluation Committee may carry out review procedures again.

Article 9    These Regulations have been implemented after approval of the University Affairs Meeting.
